Terms and Conditions for Bon Beer Voyage Virtual Tasting Events

By registering for and/or attending a tasting event with Provence Dreams LLC, Inc. d/b/a Bon Beer Voyage, you agree to be bound by these Terms and Conditions. All events are subject to the Terms and Conditions in effect on the date of booking. Please be sure to carefully read these terms and make sure you understand your rights and obligations and our rights and obligations prior to booking.

Included in the Tasting Price:

  • Bon Beer Voyage will present a guided online beer and/or wine tasting event via internet services via Zoom.
  • Bon Beer Voyage will provide to Guest(s) a curated list of beers (and/or other items, such as wine, chocolate etc. to be utilized for each particular class) for Guest to purchase once registration is made and payment is received from Guest.
  • Experienced Hosts for each Tasting Event
  • Tasting Notes for Beer and/or Wine Events
  • Trivia Breaks with Prizes

Not Included in the Tasting Price:

  • Tasting Supplies (unless otherwise made available through a 3rd party supplier and offered via Bon Beer Voyage in facilitating to procure tasting supplies on Guest’s behalf for delivery to attendees from such 3rd party purveyor.)
  • Personal Internet connection and/or connectivity fees.

When, on occasion, Tasting Products are made available through a 3rd party supplier, Guests will forward the shipping information for each of their participants at time of registration in order to allow sufficient time for products to be obtained and shipped to participants prior to event.

Tasting Products are ordered upon receipt of registration and payment and are therefore non-refundable upon cancellation of attendance to event by Guest. Any products received by attendees are non-refundable and non-exchangeable.

Bon Beer Voyage is not responsible for any delays or any other issues related to shipping and delivery of tasting products.

It is the Guest’s responsibility to ensure that all participants for which they register are 21 years of age or older.

RECORDING OF PRESENTATIONS IS STRICTLY PROHIBITED No individual or entity may electronically record, photograph, or broadcast any portion of the Bon Beer Voyage’s event(s), herein described in this agreement, without prior written consent of Bon Beer Voyage. Unauthorized recording (audio, video, still photography, etc.) of presentations, materials such as tasting notes, promotional ads, etcetera, without the express written consent of Bon Beer Voyage and individual attendees is strictly prohibited. Press representatives must receive photo/recording permission from Bon Beer Voyage. Guests are encouraged to network and enjoy the experience. As such, capturing memories, i.e., screenshots of casual meeting activities and networking is permitted with the permission of those being prominently photographed. Photographing formal meeting presentations, posters, or other materials supplied as a part of event is forbidden without permission of Bon Beer Voyage.

VIDEOS AND PHOTOS FOR BON BEER VOYAGE USE Bon Beer Voyage event attendance implies your consent and the consent of Guests to be photographed, filmed and/or otherwise recorded for use for internal training and quality control, as well as on the Bon Beer Voyage’s website or other news or marketing websites and/or publications unless otherwise expressly agreed to in writing by both Parties.

The responsibility of Bon Beer Voyage is strictly limited. As a Beer and/or Wine Tasting Presenter, Bon Beer Voyage organizes, promotes, sells and presents beer and/or wine tasting events consisting of guided tastings either online or in person, and at Guest’s request may also order and procure beer, wine, food and/or other supplies through a third party. Bon Beer Voyage acts only in the capacity of presenter, and in some cases facilitator of consumables, for Guest. Bon Beer Voyage does not own any part of the business of the Guest or of any third-party supplier(s). Bon Beer Voyage is not an agent or employee of Guest or third-party provider. As a result, Bon Beer Voyage shall not be liable for any act or failure to act of any such person, or of any other third party, nor shall Bon Beer Voyage be responsible for any personal injury or property damage whatsoever in any way related to a beer and/or wine tasting presentation.

Except to the extent paid in settlement from any applicable insurance policies, and to the extent permitted by applicable law, each Party agrees to indemnify and hold harmless the other Party, and its respective directors, shareholders, affiliates, officers, agents, employees, and permitted successors and assigns against any and all claims, losses, damages, liabilities, penalties, punitive damages, expenses, reasonable legal fees and costs of any kind or amount whatsoever, which result from or arise out of any act or omission of the indemnifying party, its respective directors, shareholders, affiliates, officers, agents, employees, and permitted successors and assigns that occurs in connection with this Agreement. This indemnification will survive the termination of this Agreement.

Without limitation, Bon Beer Voyage is not responsible for any injury, loss, or damage to person or property, death, delay, or inconvenience in connection with the provision of, or failure to provide, any goods or services occasioned by or resulting from, but not limited to, acts of God or forces of nature, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, government restrictions or regulations, or for the failure of any internet server or platform to work properly, consumption of alcoholic beverages, sickness associated with allergy or reaction to beverages, chocolates or any other products  consumed during event, breakdown of equipment, or for any other cause beyond the direct control of Bon Beer Voyage. Bon Beer Voyage has no responsibility for any reaction or intoxication of any participants or any injury or damages that may occur as a result of participating in the event.

If a dispute arises from or relates to this agreement or the breach thereof, and if the dispute cannot be settled through direct discussions, the parties agree to endeavor first to settle the dispute by mediation administered by the American Arbitration Association under its Commercial Mediation Procedures before resorting to arbitration. The parties further agree that any unresolved controversy or claim arising out of or relating to this contract, or breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

The place of arbitration shall be Palm Beach County, Florida. The arbitration shall be governed by the laws of the State of Florida. Each party shall bear its own costs and expenses and an equal share of the arbitrators’ and administrative fees of arbitration. Except as may be required by law, neither a party nor an arbitrator may disclose the existence, content, or results of any arbitration hereunder without the prior written consent of both parties.

In the event that any of the provisions of these Terms and Conditions are held to be invalid or unenforceable in whole or in part, all other provisions will nevertheless continue to be valid and enforceable with the invalid or unenforceable parts severed from the remainder of this Agreement.

By clicking on the box in the registration for your tasting event, you have indicated that you have read and agree to the Terms and Conditions for Bon Beer Voyage’s Tasting Events, you are agreeing that you  acknowledge all of the Terms and Conditions on the previous pages and hereby release and discharge forever BBV from and against any and all liability arising from your participation  and/or the participation of any of the guests you have registered for the tasting event. You agree that this release shall be legally binding upon you personally, all members of your family, your and their heirs, successors, assigns, and legal representatives. IT IS YOUR INTENTION TO FULLY ASSUME ALL RISKS ASSOCIATED WITH THIS EVENT, AND TO RELEASE BON BEER VOYAGE FROM ANY AND ALL LIABILITIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.
